Burofácil

From outside Spain · renting

I live abroad and my tenant in Spain isn't paying rent: what do I do?

Start with a burofax demanding the unpaid rent. It is not a courtesy: once 30 days have passed since they received it without paying, the tenant can no longer stop the eviction by paying at the last minute in court. From abroad you do it online: 39 € if you have the letter (we send it translated into Spanish if you write it in English, +20 €), sent on paper with proof of delivery to the flat.

Why the burofax comes first

In Spain a tenant who owes rent can, once, stop an eviction by paying everything owed before the hearing. The law takes that option away if the landlord demanded payment in a way that proves they received it, at least 30 days before filing the claim, and they didn't pay. A burofax with proof of delivery is that proof.

On top of that, since 2025 almost every civil claim in Spain requires proof that you first tried to settle. A burofax with a clear proposal (pay by this date) covers both at once.

What the letter must say

  • Your details, the tenant's, and the address of the rented flat.
  • The months owed and the exact amount, month by month, with the date of the contract.
  • Where to pay: your full IBAN. For an account outside the SEPA area, add the SWIFT or BIC code.
  • A deadline to pay and what you will do otherwise: end the contract and ask the court for eviction and the unpaid rent.
  • How to reply to you: your email and your real address, not the flat's. If you put the flat's address, any reply goes to the tenant.

How it works from abroad

  • Paste or upload your letter (PDF or Word). We check for free that it has what Spanish law requires.
  • Enter your name and address. Without an address in Spain, tick the box (+10 €): it goes out in your name «c/o Burofácil»; your address and email stay inside the letter.
  • Pay by card, Apple Pay or Google Pay. No digital certificate, no visit to any office.
  • We send it on paper with proof of delivery to the flat and email you when it is delivered and when the 30 days are up.

If the tenant doesn't collect it

If nobody is in, there is a second attempt and then the notice waits 10 days at the post office. If they never collect it, you keep proof of the delivery attempt at the address in the contract, which is where they had to receive it. Keep it: it is what you show in court.

After the 30 days

If they pay, that's it. If not, eviction for unpaid rent goes through a fast-track hearing where you can claim at the same time the rent owed and the rent that falls due until they leave. For the hearing you normally need a lawyer and a court representative (procurador) in Spain; the burofax, the proof of delivery and the contract save them work and you time.

Meanwhile, don't cut the utilities or change the lock: in Spain that can turn against you.

What Spanish law says

  • The tenant can't stop the eviction by paying if the landlord demanded payment by a means that proves receipt at least 30 days before filing, and payment wasn't made before filing (art. 22.4 Spanish Civil Procedure Act, LEC). fuente
  • Unpaid rent allows the landlord to terminate the contract (art. 27.2.a Urban Leases Act, LAU). fuente
  • The eviction claim can include the rent owed (art. 437.4 LEC). fuente
  • Before suing you must try to settle; a burofax with a proposal and a deadline proves it (Organic Law 1/2025). fuente

Frequently asked questions

Do I need an address in Spain to send it?
No. It goes out in your name with our address as sender («c/o Burofácil», +10 €). That is only the envelope: your address and email go in the letter, so they reply to you.
Can I write it in English?
Yes. We send it translated into Spanish (+20 €); you check the translation before paying and keep your original. A Spanish court reads the Spanish version.
What if the tenant refuses to collect it?
You keep proof of the delivery attempt at the address in the contract. Refusing or not collecting it doesn't help them: the burofax went where it had to go.
Can you draft it for me?
Yes, from your answers to a short form (59 € from abroad). The form is in Spanish for now; if that is a problem, write the letter in English and we translate it.
